By accessing, browsing, or using VitalYears services (website, phone consultations, booking services), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please discontinue use immediately.
Capacity to Contract:
You represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If booking for others, you represent that you have their authority to do so.
2. Service Description and Scope
VitalYears Services Include:
- Travel planning and consultation services
- Booking coordination with third-party providers
- Pre-travel preparation and guidance
- Travel support and assistance services
- Educational content and travel resources
Service Limitations:
- We are travel service coordinators, not direct service providers
- All travel services are subject to third-party availability
- Services may be modified due to circumstances beyond our control
- Actual travel experiences may vary from descriptions
3. Booking Process and Confirmation
Booking Procedures:
- All bookings require written confirmation from VitalYears
- Verbal agreements are subject to written confirmation
- Prices are estimates until final confirmation
- Availability is not guaranteed until payment is processed
- Special requests are subject to third-party acceptance
Booking Modifications:
Changes to confirmed bookings may incur additional fees and are subject to availability. Modification requests must be submitted in writing and may require new terms and conditions from service providers.
4. Payment Terms and Pricing
Payment Requirements:
- Payment schedules vary by service and destination
- Final payment typically required 60-90 days before travel
- Late payment may result in booking cancellation
- Payment methods: major credit cards, bank transfers, certified checks
- All payments processed through secure, PCI-compliant systems
Pricing and Fees:
- Prices include specified services only
- Additional fees may apply for changes, upgrades, or add-ons
- Taxes, tips, and personal expenses typically not included
- Currency fluctuations may affect international pricing
- Price matching not available due to service customization
Refund Processing:
Refunds, when applicable, will be processed to the original payment method within 10-14 business days after approval. Processing times may vary by financial institution.
5. Cancellation and Refund Policy
Cancellation by Customer:
- More than 120 days before travel: Full refund minus $500 processing fee
- 90-120 days before travel: 75% refund
- 60-89 days before travel: 50% refund
- 30-59 days before travel: 25% refund
- Less than 30 days before travel: No refund (travel insurance may cover)
Cancellation by VitalYears:
If we cancel your trip for reasons within our control, you will receive a full refund or the option to reschedule at no additional cost. Force majeure events may result in different terms.
Travel Insurance Recommendation:
We strongly recommend purchasing comprehensive travel insurance to protect against unforeseen circumstances, medical emergencies, and trip disruptions.
6. Health, Safety, and Medical Requirements
Health Disclosure Requirements:
- Travelers must disclose relevant medical conditions
- Fitness requirements vary by destination and activities
- Medical clearance may be required for certain trips
- Failure to disclose may result in service denial
Safety Responsibilities:
- Travelers are responsible for their personal safety
- Follow all safety guidelines and local laws
- Participate in safety briefings and orientation
- Report safety concerns immediately to guides
Medical Support Limitations:
While we provide access to medical support services, we are not medical professionals and cannot provide medical diagnosis, treatment, or emergency medical services beyond basic first aid.
7. Travel Documentation and Requirements
Required Documentation:
- Valid passport (6+ months validity for international travel)
- Appropriate visas and travel permits
- Vaccination certificates as required
- Travel insurance documentation
- Emergency contact information
Customer Responsibility:
Customers are solely responsible for obtaining proper travel documentation. VitalYears provides guidance but cannot guarantee documentation acceptance by authorities.
8. Third-Party Service Providers
Relationship Clarification:
VitalYears acts as an intermediary coordinating services from independent third-party providers including airlines, hotels, tour operators, restaurants, and activity providers. We are not responsible for their actions, omissions, or service quality.
Third-Party Terms:
Third-party services are subject to their own terms and conditions, which may include different cancellation policies, liability limitations, and service standards.
9. Limitation of Liability and Disclaimers
Liability Limitations:
- Maximum liability limited to total amount paid to VitalYears
- No liability for indirect, incidental, or consequential damages
- No liability for third-party service provider actions
- No liability for force majeure events
- No liability for personal property loss or damage
Excluded Damages:
VitalYears is not liable for lost profits, business interruption, emotional distress, punitive damages, or any damages exceeding the amount paid for services.
10. Force Majeure and Extraordinary Circumstances
Force Majeure Events Include:
- Natural disasters and severe weather
- Pandemics and health emergencies
- Political instability and government actions
- Terrorism and security threats
- Labor disputes and strikes
- Infrastructure failures
Force Majeure Response:
In force majeure situations, VitalYears will work to minimize disruption but cannot guarantee service delivery or provide compensation beyond refunding unused services.
11. Acceptable Use and Conduct
Prohibited Conduct:
- Harassment of staff, guides, or other travelers
- Illegal activities or substance abuse
- Disruptive or dangerous behavior
- Damage to property or environment
- Violation of local laws and customs
Consequences:
Violations may result in immediate removal from services without refund, legal action, and responsibility for additional costs incurred.
12. Intellectual Property Rights
VitalYears Property:
All website content, logos, trademarks, and materials are owned by VitalYears or licensed for use. Unauthorized reproduction, distribution, or commercial use is prohibited.
User-Generated Content:
By providing reviews, photos, or feedback, you grant VitalYears permission to use this content for marketing and promotional purposes.
13. Privacy and Data Protection
Collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. We comply with applicable data protection laws including GDPR and CCPA.
14. Google Ads and Business Policy Compliance
Advertising Standards:
- All marketing claims are truthful and substantiated
- Service descriptions accurately reflect offerings
- Pricing information is clearly disclosed
- Terms and conditions are readily accessible
- Customer testimonials represent genuine experiences
Business Practice Commitments:
- Transparent and ethical business practices
- Prompt and professional customer service
- Fair resolution of disputes and complaints
- Compliance with advertising and consumer protection laws

15. Dispute Resolution
Informal Resolution:
We encourage customers to contact us directly to resolve any concerns. Most issues can be resolved through good-faith communication.
Formal Disputes:
For disputes that cannot be resolved informally, parties agree to binding arbitration under the rules of the American Arbitration Association, conducted in Sacramento County, California.
Class Action Waiver:
To the extent permitted by law, parties waive the right to participate in class action lawsuits or class-wide arbitration.
16. Governing Law and Jurisdiction
These Terms are governed by California state law and federal law of the United States. Jurisdiction for any legal proceedings is in the state and federal courts of Sacramento County, California.
17. Modifications and Updates

VitalYears reserves the right to modify these Terms with 30 days' notice for material changes. Notice will be provided via email and website posting.
Continued Use:
Continued use of services after notice constitutes acceptance of modified Terms. If you disagree with changes, discontinue use and contact us regarding existing bookings.
18. Severability and Entire Agreement
Severability:
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Entire Agreement:
These Terms, together with our Privacy Policy and any service-specific terms, constitute the entire agreement between parties.
